Terms Of Service
Effective as of March 2026. Standard terms governing agency services, project deliverables, and website usage.
1. Engagement & Retainer Scope
All digital marketing, performance advertising, video production shoots, web engineering, and automation projects undertaken by THE GROW AGENCY are governed by formal statements of work (SOW) executed between THE GROW AGENCY and the client.
2. Intellectual Property Rights
Upon settlement of all project invoices, final approved deliverables—including bespoke video creatives, graphic assets, brand guideline manuals, and custom source code—become the exclusive intellectual property of the client, unless specified otherwise in individual software licensing agreements.
3. Ad Spend & Media Budgets
All direct advertising fees incurred on third-party ad networks (Meta Ads, Google Ads, YouTube, LinkedIn) are paid directly by the client to the respective platforms. THE GROW AGENCY manages these campaigns under strict authorized budgets.
4. Jurisdiction
These terms and any disputes arising hereunder shall be subject to the exclusive jurisdiction of the commercial courts of Surat, Gujarat, India.
